(5) On the further ground that the first clause of the eighth section of the first article confers upon the Federal Government the distinct authority to appropriate money for any purpose which in their judgment provides for the common defense and promotes the general welfare; and that if in the judgment of the Federal Congress the establishment and maintenance of a national university would be in furtherance of the general welfare, then the authority to take such action is clearly and distinctly conferred by this clause.
